PROPERLY DETERMINE SCA APPLICABILITY

Does SCA apply?  We’ll help you determine SCA applicability and if your contract contains the SCA clause and one or more incorporated wage determinations

WAGE DETERMINATION ASSISTANCE

The only wage determination to follow is the one incorporated into the contract by the contracting office.  Complying with a wage determination that is not a formal part of the contract may be hurting the profitability of your SCA contract.  We assist by helping SCA contractors avoid using wrong wage determinations.

IDENTIFYING WHO IS COVERED BY THE SCA

Often, companies incorrectly assume that part-time and temporary employees and independent contractors are either exempt or someone else’s responsibility.  SCA compliance is the responsibility of the prime contractor and we assist with SCA coverage determination.

In addition to employee coverage, it is equally important to determine the proper labor category classification as the associated wage requirements vary.  We assist with this challenging critical task.

DISTINGUISHING WAGES vs. HEALTH & WELFARE

Under the SCA, if a contractor pays an employee $1.50/hour more than the required wages, but $0.25 less than the required health and welfare, the contract is non-compliant. Contractors must show that the wages and health and welfare requirements are separately fulfilled.  We assist and ensure these requirements are fulfilled.

These fringe benefits are a legally enforceable obligation that must be communicated in writing to employees.  The fringe benefits provide benefits not required by law under a defined formula and must be paid via an independent party or administrator to fund a plan.
